Brand Ambassador Terms & Conditions

These Brand Ambassador Terms & Conditions "Agreements" set forth the terms and conditions under which you "Brand Ambassador" shall participate in the brand ambassador program of Foyer D'art, a company specializing in the sale of love-related items.

By participating in the program, you agree to the following terms:

1. Eligibility:

a. You must be at least 18 years old and reside in the United States of America to become a Brand Ambassador.
b. You must have an active and engaging social media presence on platforms relevant to the brand (e.g., TikTok, Instagram, Facebook, YouTube).
c. You must follow all applicable laws and regulations while promoting the brand's products.

2. Appointment as Brand Ambassador:
a. You will be appointed as a non-exclusive Brand Ambassador for the brand.
b.The appointment will be initially valid for a period of twelve (12) months and will be automatically extended unless the parties agree otherwise.

3. Brand Ambassador Responsibilities:
a. Promote the brand's products in a positive and authentic manner on your social media platforms.
b. Create and share high-quality, original content showcasing the brand's products, including product photos, unboxing videos, and personal testimonials.
c. When promoting the products, make sure to mention the official social media accounts of the brand and include the specified hashtags (#foyerdart and #loveisamazing).
d. Refrain from engaging in any false, misleading, or deceptive advertising about the brand or its products.
e. Avoid promoting the brand in a way that could be considered offensive, discriminatory, or harmful to any individual or group.

4. Property:
a. The brand reserves all rights and interest in its logos, and other property associated with its products.
b. You grant the brand a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the content you create, including but not limited to photos, posts, videos, etc., while promoting the brand's products for marketing purposes.

5. Benefits:
a. As a Brand Ambassador, you may receive a free product, exclusive discounts, or other incentives at the brand's discretion.
b. You have the opportunity to earn 15% commission for every sale made using your unique coupon code, allowing you to make money while spreading love and happiness to your audience.
c. Your compensation will be provided on a monthly basis, and the payments will be deposited into your PayPal account one month after the sales have been completed. To illustrate, if you generate sales during the month of September, spanning from the 1st to the 30th, your payment will be processed on October 31st.
d. In order to receive payment, it's essential to possess a PayPal account. If you don't already have one, you can create a PayPal account at no cost by clicking on this link.
e. You will receive an exclusive coupon code to share with your followers, granting them special discounts on our love-related products, enhancing their shopping experience.
f. You will receive a FREE promotional item from our collection to showcase to your audience and experience our products firsthand.

6. Confidentiality:
a. During the term of this agreement and thereafter, you shall not disclose any confidential information, trade secrets, or proprietary information related to the brand or its products.

7. Termination:
a. Either party may terminate this agreement with or without cause upon giving written notice to the other party.
b. Upon termination, you shall cease using any logos or promotional materials associated with the brand.

8. Compliance with Laws:
a. You shall comply with all applicable laws, regulations, and guidelines while participating in the program.

9. Indemnification:
a. You shall indemnify and hold the brand harmless from any claims, damages, losses, or liabilities arising out of your actions as a Brand Ambassador.

10. Modification:
a. The brand may modify or update these Terms & Conditions at any time, and you will be notified of any changes.

11. Posting Requirements:
a. As a Brand Ambassador, you agree to post photos, videos, and other content related to the brand's products at least twice (2 times) a month on your designated social media platforms. Make sure to mention the official social media accounts of the brand.
b. The content posted should be authentic, creative, and align with the brand's image and values.
c. In the event of any unforeseen circumstances that may prevent you from meeting the posting requirements, you shall inform us, the Foyer D'art team, in advance and seek approval for any necessary adjustments.

12. Hashtag Usage:
a. When posting content related to the brand's products, you shall include the hashtags #foyerdart and #loveisamazing in the caption or description of each post.
b. Proper usage of the designated hashtags is essential for tracking and monitoring the effectiveness of your promotional efforts.
